It is very important that we keep close attention to The Pirate Bay Trials. The Pirate Bay not only represents a voice against the greedy profit hungry corporate giants (not mentioning any names, since I work closely with some of them), but these trials will also shape the laws that will regulate internet usage in the future.
I do not believe that TPB is innocent and clear of any copyright infringement. For sure, they have contributed or encouraged such infringements to be violated by seeders. However, for them to take the blame for the whole situation or this BT trend (in a more extreme POV), makes them a scapegoat for crimes conducted by the people (yes everyone, even you and me). Who hasn't seen a pirated version of some movie that is not even out at the theatres yet? Who hasn't burn copies of dvds or photocopied written material for their own use without actually paying for them. Everybody has. If you are saying to me, "I haven't I haven't violated a single copyright crime in my life." Well then not only are you a liar but you are also negligently wrong, because most likely you have plaigarized as a child in school before they became so strict with plaigarism in schools in recent years.
There must be a market before there is a product. In this case, it's normal that people would want freebies when there is no law restricting them to do so. On the other hand, when they are selling Dark Knight Blu-Ray for 2XX, while it only cost them around $10-$20 a copy to make. It is awfully tempting to hit that downloading button. Once again I am not justifying these actions, but these samples may also have contributed to such unhealthy trends and disrespect for intellectual property.
So I guess everyone has heard about the pirates bay guys going to battle in court over in Europe. Now the fact that everyone here is an artist, I will probably have a huge amount of people leaving comments on my blog saying "To Hell WIth Pirate Bay!!!." And I, a creative personnel is also against infringement of copyrights for commercial purposes as well.
However, we need to look into the case. I mean if we just look at Pirates Bay and what it represents we are simply mislead to what kind of infringement these people have violated and not exactly is the law they have broken.
Pirates Bay is a website that direct people to files (seeders, or "uploaders"). To make an example. If a Park N' Shop carried poisonous milk powder from China, are they liable as the manufacturers (company of the milk powder) themselves?
The other accusations from the European courts is that "The Pirate Bay" (TPB) has continued to operate its website even after several charges been charged on the website. But then again? What copyright law have they infringed?
